Criterion text
Upon the start of the agreement, the supplier must declare presence of the substances included on the current REACH Candidate List, (article 59 of Regulation (EG) no. 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals), in concentrations exceeding 0.1 percent by weight, (1.000mg/kg), per substance in the offered products. 0.1 percent by weight concerns every individual part of a product.
If new substances are added to the list during the [framework agreement period/contract period] and these substances appear in procured products above the specified limit value, the supplier is responsible for notifying the customer in writing of the change. The supplier must also, on request, be able to present an action plan for how the substance can be phased out.
1Percent by weight applies to each individual part of a composite product and thus means, not 0.1% of a composite product, but 0.1% of each constituent component thereof. For further information, see the Swedish Chemicals Agency website.
Verification
By submitting its tender, the supplier accepts that this special contract term shall be fulfilled at the specified time.
Proposed follow-up
Spot check technical documentation from manufacturers and material suppliers. If necessary, analytical testing can be carried out.
Analysis report
Follow up the special contract term by requesting analysis reports for spot checked items and confirming that the values shown are below the contract term's threshold limit for any substances on the Candidate List that are present in the equipment. Check that the analyses have also been performed by a laboratory that is accredited for the analytical method used.
Self-declaration verified by an accredited verification body
If a verified self-declaration is used as verification for the requirement, request the supplier's self-declaration along with documentation showing that the requirement is met. A self-declaration shall be verified by a verification body accredited for the task in accordance with ISO/IEC 17029 or an equivalent standard.
Information about the criterion
The requirement is recommended for the following new and refurbished equipment:
- laptops
- desktop and all-in-one computers
- monitors
- smartphones and tablets.
The European Chemicals Agency (Echa) publishes a list on substances of very high concern (SVHC). This list is called the Candidate List. The substances can be carcinogenic, mutagenic, and reprotoxic (CMR), as well as Persistent, Bioaccumulative, and Toxic (PBT). The current list can be found at the European Chemicals Agency's web site.
The supplier or reseller is legally obliged to supply information to the contracting authority concerning the presence of substances in the Candidate List in products in concentrations exceeding 0.1% by weight. Thus, this requirement can be used to secure compliance to the REACH declaration.
