Criterion text
During the entire contract period, the supplier shall be able to provide information on whether the consumables delivered in accordance with the contract contain substances included on the current Candidate List (Article 59 of Regulation (EC) No 1907/2006 (Reach)) in concentrations exceeding 0.1 percent by weight (1000 mg/kg). 0.1 percent by weight applies to each individual part of a product1.
If new substances are entered on the Candidate List during the contract period, the supplier shall inform the contracting authority if these substances are present in the products covered by the contract.
In its tender, the supplier shall provide a brief description on how the supplier keeps information regarding substances on the candidate list that are present in the products available, as well as which routines ensure that this information is kept up-to-date.
1Percent by weight applies to each individual part of a composite item and thus means, not 0.1 percent of a composite product, but 0.1 percent of each constituent part.
Verification
The supplier's acceptance of the tender means that the contract terms will be fulfilled at the times specified in the contract. This can be followed up during the term of the contract.
Proposed follow-up
Request a compilation of the substances on the candidate list that occurs in concentrations above 0.1 percent by weight in the products. Substances that are not present in concentrations above the specified concentration do not need to be listed.
Check that the supplier has routines to ensure that the information on substances of very high concern (SVHC) is kept up to date in connection with new substances being added to the candidate list and for forwarding this information to the procuring organization.
Perform spot checks on technical documentation from manufacturers and material suppliers. At follow-up meetings, a review can be made on which SVHC:s are included in the products and in what concentrations they are included, as well as whether updates to the candidate list affect the products included in the contract.
Self-declaration verified by an accredited verification body
Follow up on the contract term by requesting the supplier’s self-declaration, including documentation showing that the requirement is met. The self-declaration shall be verified by a verification body accredited for the task in accordance with ISO / IEC 17029 or equivalent standard.
Information about the criterion
Submitting information about substances on the candidate list is a legal requirement as regards sales to a commercial customer, for example a procuring authority. The requirement is set for the contracting authority to be able to ensure compliance with the legislation.
To fulfil this requirement, the tenderer should have a functioning quality management system i.e., a system for quality assurance where chemical control is included, according to the qualification requirement.
The contracting authority should also have a functioning chemical work and resources to handle and follow up incoming information.
There are currently a limited number of accredited verification bodies for ISO/IEC 17029 (Conformity assessment - General principles and requirements for validation and verification bodies) as it is a relatively new standard. This may change, especially if the demand for verifying compliance in this way increases. More information about the standard and accredited verification bodies can be found on Swedac's website.
